xAI Sues Colorado Over AI Law, Alleging Free-Speech Violation

Colorado Governor Jared Polis signed SB24-205 on May 17, 2024, making it the first comprehensive U.S. state law regulating high-risk AI. It required developers and users to guard against “algorithmic discrimination” in decisions involving employment, housing, credit, education and healthcare. At the heart of the dispute is whether consumer protections can extend to model design and outputs, raising questions about the limits of state regulatory authority and the First Amendment.

On April 9, 2026, xAI sued Colorado Attorney General Philip Weiser in federal district court in Colorado, arguing that the law forced Grok to adopt viewpoints favored by the state government. The U.S. Justice Department intervened in support of xAI on April 24, and the court paused enforcement on April 27. Polis then signed SB26-189 on May 14, replacing the original law and postponing its main obligations until January 1, 2027. The court has yet to decide whether the lawsuit is now moot.
