US Judge Dismisses xAI Trade-Secrets Lawsuit Against OpenAI

Elon Musk’s xAI and Sam Altman-led OpenAI are competing in the generative AI market. In September 2025, xAI sued, alleging that several former employees took confidential information involving Grok source code, data-center operations and model post-training when they joined OpenAI. No specific damages were publicly disclosed, and the case centered on whether the movement of employees amounted to trade-secret misappropriation.

On June 15, 2026, US District Judge Rita Lin of the Northern District of California dismissed xAI’s amended complaint. She found that asking about previous work during an interview was not enough to infer that OpenAI had directed former senior xAI engineer Xuechen Li to disclose confidential information, and that there was no evidence OpenAI engineers knew of any disclosure. The court first dismissed the case with leave to amend on February 24; the latest ruling marks another defeat for xAI.
