New York Financial Regulator Focuses on Liability in Agentic Commerce and Payments
The New York State Department of Financial Services (NYDFS) oversees financial activities including banking, insurance and payments. As AI agents gain the ability to select products, authorize payments and automatically complete transactions on users’ behalf, traditional frameworks that assign liability to consumers or merchants face new challenges. Identity verification, disputed charges and consumer protection have consequently become regulatory priorities.
NYDFS recently said it was closely examining agentic commerce and payment technologies as it develops its regulatory position. The acting superintendent said transactions executed autonomously by AI present regulators with an entirely new issue. No formal rules, implementation date, transaction-value thresholds or penalty standards have been announced. The key question ahead will be who bears liability for unauthorized transactions and resulting losses.
