O’Leary Sees Congress Reviving CLARITY in Early 2027
The Digital Asset Market Clarity Act is intended to create a federal framework for crypto markets and delineate the roles of the Securities and Exchange Commission and Commodity Futures Trading Commission. A parallel measure, the Digital Asset Tax Certainty Act, would set tax rules for staking, mining, small crypto transactions and broker requirements. The two bills matter because Washington is moving to collect revenue from digital-asset activity while core questions over its regulation remain unresolved.
The Senate voted on Sept. 15 to advance CLARITY, but the measure drew 49 votes, short of the 60 required. On Sept. 16, the House Ways and Means Committee advanced the tax bill. Kevin O’Leary told the Avalanche Summit in New York on Sept. 17 that taxation would intensify pressure for clear policy, predicting lawmakers would revive market-structure legislation after the 2026 midterm elections, probably in the first or second quarter of 2027.
